DECISION OF THE TRIBUNAL: January 5, 2016
This is an application under the Pay Equity Act, R.S.O. 1990 (“the Act”), objecting to an Order of a Review Officer.
Section 4.2(1) of the Statutory Powers Procedure Act permits a panel of one to issue this decision.
The applicant (“the Employer”) takes issue with the Review Officer’s jurisdiction to have made the Order.
The Pay Equity Office (“the Office”) seeks to participate in this proceeding to address the jurisdictional question.
The Office has advised that the Employer and the Canadian Union of Public Employees (“CUPE”) consent to its participation on this basis, and that the individual employee respondents have not indicated their position with respect to the request. The Office notes that the Tribunal has permitted it to intervene in the past where issues relating to the jurisdiction of Review Officers are raised.
The Office is hereby added as an intervenor to this proceeding, but its right to intervene is confined to addressing the question of the jurisdiction of the Review Officer. The title of the proceeding is amended accordingly.
