DECISION OF THE TRIBUNAL: January 5, 2016
These are applications under the Pay Equity Act, R.S.O. 1990, c.P.7, as amended.
In our decision dated December 18, 2015 we set out a suggested process whereby the Tribunal will deal with the request by Ottawa-Carleton Public Employees’ Union (CUPE), Local 503 (“Local 503”) for reconsideration of our earlier decision dated February 3, 2015. The parties were given until December 24, 2015 to file any objections to the proposed process.
Counsel for Local 503 wrote to the Tribunal on December 18, 2015, expressing agreement with our proposal, and counsel submitted a suggested time frame for completion of all steps. The Tribunal received no objection from Ottawa Public Library Board (“OPL”) to counsel for Local 503’s letter, or to our decision of December 18, 2015.
Accordingly, we make the following orders:
(i) The OPL is to provide Local 503 with production of copies of the records of pay equity payments made in 2006 and the job classes to which they were paid by January 29, 2016;
(ii) If, following its review of the documents produced by the OPL, Local 503 has any concerns with respect to being able to proceed by written submissions, it is to notify the OPL and the Tribunal by February 5, 2016, and in the absence of any such concerns, Local 503 is to provide its written submissions to the OPL and the Tribunal by February 12, 2016;
(iii) The OPL is to provide its written submissions in response by February 26, 2016;
(iv) Local 503 is to provide its written submissions in reply by March 4, 2016.
