DECISION OF THE TRIBUNAL: May 4, 2016
This decision relates to a proceeding commenced under the Pay Equity Act, R.S.O. 1990, c. P.7, as amended (“the Act”).
Section 4.2(1) of the Statutory Powers Procedure Act permits a panel of one to issue this decision.
By letter dated April 29, 2016, the Pay Equity Office (“the Office”) has advised the Tribunal of the following:
The Seguin Public Library Board (“the Employer”) posted a pay equity plan on November 26, 2015 (“the Employer’s Plan”);
Objections to the Employer’s Plan were made to Review Services;
By Order dated March 31, 2016 (“the Order”), a Review Officer resolved the objections and ordered the Employer to post an amended plan (“the Amended Plan”);
The Employer posted the Amended Plan on April 6, 2016;
On April 26, 2015, Nadine Triemstra filed an objection to the Amended Plan with the Office.
The Office further advises that it will not be investigating Ms. Triemstra’s objection, and notes that section 17(1) of the Act requires the Tribunal to hold a hearing into the objection.
The letter indicates on its face that a copy of it was sent to Ms. Triemstra, however, it does not appear to have been sent to the Employer. The Employer is entitled to notice of the objection and the right to participate in any hearing before the Tribunal.
Should Ms. Triemstra wish to pursue her objection before the Tribunal, she must comply with its Rules of Practice. Pursuant to Rule 10, she must file a completed Application with the Tribunal, and deliver a copy of it to the Employer and file a completed Statement of Service providing the details of such delivery. If Ms. Triemstra does not file a completed Application (including a Statement of Service) with the Tribunal on or before May 19, 2016, she will be deemed to have abandoned her objection to the Order and Amended Plan.
