DECISION OF THE TRIBUNAL: November 3, 2015
Section 4.2(1) of the Statutory Powers Procedure Act permits a panel of one to decide this matter.
The Tribunal is in receipt of a request by a media reporter (“the reporter”) to review the application, the responses to the application, any affidavits and factum or written arguments and any Notices of Hearing or Mediation in this matter.
I note first that there was no response filed to the application. Also, there were no affidavits or factums filed, and the matter was never scheduled for a hearing or mediation.
Canadian Union of Public Employees, Local 4392 (“CUPE”), a respondent in a related Tribunal File, made written submissions dated March 23, 2015 concerning the remedies sought by the applicant in this matter. The respondent in this matter, Community Living Guelph Wellington (CLGW), filed brief submissions dated March 26, 2015 in response to those of CUPE. Arguably both CUPE’s and CLGW’s written submissions constitute written arguments which are encompassed by the request for disclosure.
If any of the parties or CUPE has any objection to permitting the reporter access to the application and the written submissions referred to in the preceding paragraph, they are to file their written submissions on or before November 10, 2015.
In the absence of any objection, the Tribunal will grant the reporter’s request.
