DECISION OF THE TRIBUNAL: October 22, 2015
1These are applications under the Pay Equity Act, R.S.O. c. P.7, as amended (“the Act”).
2Section 4.2(1) of the Statutory Powers Procedure Act permits a panel of one to decide the procedural issue at hand.
3By decision dated October 20, 2015, the Board directed the parties to refrain from filing their submissions on the preliminary issue pending the applicant’s decision on whether it would like to withdraw its applications. By correspondence dated October 21, 2015, the applicant confirmed that it would like its applications to proceed.
4Under the circumstances, the applicant and the other parties (other than the Crown) have until October 29 to deliver to the other parties and file with the Board their submissions on the preliminary issue. The Crown has until November 5, 2015 to deliver to the other parties and file with the Board its submission on the preliminary issue. I note that the Ontario Public Service Employees Union, Local 226 (“OPSEU”) is to deliver and file its response together with its submission on the preliminary issue.
