DECISION OF THE TRIBUNAL: January 16, 2015
1This is an application under the Pay Equity Act, R.S.O. 1990, c. P.7, as amended (“the Act”).
2Section 4.2(1) of the Statutory Powers Procedure Act permits a panel of one to decide this matter.
3The application was commenced in June 2012. A Pre-Hearing Conference was held on December 7, 2012, and a further one was scheduled along with two hearing dates in December 2013. All of those dates were cancelled on the consent of the parties. No terms or conditions were imposed on the cancellations, and the matter was not treated as an adjournment sine die of the application. Had it been so treated, the matter would have automatically terminated a year later in the absence of any request that it proceed.
4The parties have not sought to proceed with this matter before the Tribunal in 2014, and they have not responded to the written request of the Registrar to update them on the status of this file by January 12, 2015.
5This application is terminated.
