DECISION OF THE TRIBUNAL: February 25, 2015
1. This is an application under the Pay Equity Act.
2. In our decision dated February 20, 2015 we granted an adjournment of the hearing scheduled for February 23, 2015 on the basis of counsel for the applicant’s unavailability due to a recent medical condition necessitating immediate bed rest and the cessation of all work activity. We deferred adjourning the next scheduled hearing date of February 27, 2015 pending our review of the materials that counsel for the applicant submitted in support of a motion that the applicant wishes to make before the hearing panel.
3. We have now had an opportunity to review those materials. We may provide further direction to the parties in respect of the applicant’s motion prior to a hearing. However, since counsel of record is not available, and given that in the circumstances it would not be reasonable to expect that carriage of this particular matter would be transferred to another lawyer in the firm’s relatively small employment and labour section on short notice, the hearing scheduled for February 27, 2015 is also adjourned.
4. The Registrar is directed to schedule a day of hearing in August 2015 if the Tribunal’s schedule allows, otherwise on a date thereafter.
