PAY EQUITY HEARINGS TRIBUNAL
PEHT Case No: 2783-09-PE
Maitland Manor Health Care Centre, Applicant v Rick Mattuci, Lori Stephens, Denise Lockie, Natalie Miltenburg, Amanda Beddow, Becky Jarvis, Angela Leggatt, Beth Sorensen, Crystal Agombar, Karen Eckenswiller and Joan McDougall, Respondents v Pay Equity Office, Intervenor
BEFORE: Patrick Kelly, Vice-Chair, Ann Burke and Carol Phillips, Members
DECISION OF THE TRIBUNAL: December 5, 2014
This is an application under the Pay Equity Act.
The Tribunal is in receipt of correspondence from counsel for the applicant requesting - with the consent of the Pay Equity Office (“the PEO”) - an adjournment of the hearing scheduled for December 11, 2014.
This case has been ongoing for a lengthy period of time, and there have been several adjournments. The applicant and the Pay Equity Office have been in discussions and have exchanged materials in an attempt to narrow the issues to be presented and determined, and to possibly limit the involvement of the Pay Equity Office in the hearing. That is all well and good, but there are responding party employees who also have an interest in seeing that this matter is heard and determined.
The efforts of the applicant and the PEO to get the case ready for hearing have recently been hampered by medical issues faced by counsel for the applicant, and for that reason alone we are prepared to grant an adjournment of the hearing. The Tribunal has the following dates available for one day of hearing: March 30, 2015 and April 7 or 10, 2015. The parties have until December 10, 2014 to advise the Registrar of their availability, otherwise one of the aforementioned dates or some other date may be set by the Registrar peremptorily.
The parties should not expect that the Tribunal will grant further adjournments except in the most compelling of circumstances.
Dated at Toronto this 5th day of December, 2014.
