Pay Equity Hearings Tribunal
PEHT Case No: 0413-13-PE
Regional Nursing Services, Applicant v Helen Magno, Agnes Yuen-Mui Ng, Richard Burke, David Leung, Sophia Chu, Pan YuLing, Crystal McLean, Sindy Kwong, Cecilia Ng, Omotunde Okonkwo, Jacqueline Rodney and Anna Gullo, Respondents
BEFORE: Patrick Kelly, Vice-Chair
DECISION OF THE TRIBUNAL: October 15, 2014
1This is an application under the Pay Equity Act.
2Section 4.2(1) of the Statutory Powers Procedure Act permits a panel of one to decide this matter.
3In a letter received by the Tribunal on October 14, 2014, Karen Jackson has advised the Tribunal that she wishes to be removed as a party in this matter. Accordingly, Ms. Jackson is removed as a responding party.
4The Tribunal also received correspondence on October 14, 2014 from Sohail Iqbal indicating he holds a Power of Attorney in respect of Helen Benjamin, an individual who was listed for a pay equity adjustment in Schedule A of the Order dated January 8, 2013 (“the Order”) that is the subject of this application. Mr. Iqbal asks that he be listed as a contact for Ms. Benjamin and that he be kept “posted on this file.”
5To the extent that Ms. Benjamin wishes to participate or have Mr. Iqbal participate on her behalf as a responding party (and therefore be entitled to receive all notices and decisions of the Tribunal) it would be necessary to file a response to the application with the Tribunal and deliver it to the applicant in compliance with the Tribunal’s Rules of Practice. However, it is not clear to me that this is the reason behind Mr. Iqbal’s letter. It may be that all he is seeking on behalf of Ms. Benjamin is the benefit of the pay equity adjustment under the Order. If that is the case, he should contact counsel for the applicant at the address set out in the attachment to this decision.
Dated at Toronto, Ontario this 15th day of October, 2014.
