Decision

1This is an application under the Pay Equity Act, R.S.O. 1990, c. P.7 as amended (“the Act”) for review of an Order dated, November 12, 2009 issued by Review Officer Tiziana Isgro (“the Officer”).

2In our previous decision dated June 19, 2013, we noted that settlement discussions between the applicant and the responding party employees ended on June 17, 2013 without any apparent prospect for revival on the next scheduled Pre-Hearing Conference scheduled for August 21, 2013. Accordingly, we determined that August 21, 2013 would be utilized as a hearing date.

3By way of letter dated July 25, 2013, counsel for the Pay Equity Office (“the PEO”) pointed out that, prior to the scheduling of the settlement meetings of June 17, 2013 and August 21, 2013, the applicant and the PEO had been engaged in settlement discussions of their own, which were then postponed to facilitate the other set of settlement negotiations between the applicant and the responding party employees. Counsel for the PEO therefore requests that the Tribunal set August 21, 2013 as a Pre-Hearing Conference so that the applicant and the PEO can continue to explore a resolution of this matter.

4In the circumstances, we are of the view that the hearing ought not to proceed on August 21, 2013. Instead, the applicant and the PEO are to attend that day at the Tribunal’s office for the purpose of resuming their discussions concerning resolution of the application. The responding party employees may also attend, if they wish. To the extent necessary, this panel of the Tribunal will be available to the parties for the purposes of assisting them and/or determining any case management issues, including the setting of a hearing date, should that be required.
