DECISION OF THE TRIBUNAL: March 22, 2011
The Tribunal is in receipt of an application filed by Phung Kim Quach. The application was received by the Tribunal on March 11, 2011. It has been assigned File No. 4159-10-PE.
Ms. Quach states that she filed a complaint with the Pay Equity Commission on November 8, 2010. It would appear from Ms. Quach’s application that a Review Officer was assigned to investigate her complaint. What is not clear from Ms. Quach’s application is whether the Review Officer issued an Order or advised Ms. Quach that she would not be making an Oorder.
In order for the application filed by Ms. Quach to be accepted by the Tribunal, Ms. Quach must provide the Tribunal with a copy of the Review Officer’s Order or decision not to issue an Order or an explanation as to why the Tribunal would accept the application prior to the Review Officer having concluded her investigation and made a decision.
Ms. Quach is hereby directed to deliver to the other parties and file with the Tribunal a copy of the Order or decision of the Review Officer issued in connection with the complaint that Ms. Quach made to the Pay Equity Commission on November 8, 2010 no later than 10 days from the date of this decision. If the Review Officer has not yet issued an Order or a decision, Ms. Quach is directed to deliver to the other parties and file with the Tribunal an explanation as to why the Tribunal would accept her application before the Review Officer has had a chance to complete her investigation and make a decision no later than 10 days from the date of this decision.
If Ms. Quach does not file anything with the Tribunal within 10 days of the date of this decision as directed herein, this matter will be deemed to be automatically terminated without any further notice to the parties.
