[1]. This matter is a referral to the Pay Equity Hearings Tribunal by the Pay Equity Office pursuant to section 24(5) of the *Pay Equity Act*, R.S.O. 1990, Chapter P.7 (the “Act”). The application was served on Trend-Line Furniture Ltd. (“Trend-Line”) on November 25, 2010. According to the Tribunal’s Rules of Practice, Trend-Line had 10 days to file a response. Thus, Trend-Line’s response was due December 9, 2010. To date no response has been filed.
[2]. Trend-Line has written a letter to the Registrar of the Pay Equity Hearings Tribunal, asking for an extension of time to comply with the Order that is the subject of the application. This letter was received by the Tribunal on December 6, 2010. It is unclear from the letter if Trend-Line is asking for an extension of time to file its response to the application or whether it is asking the Tribunal to vary the Order to give Trend‑Line a longer period of time to provide the information that the Order requires it to provide. If Trend-Line wants to Tribunal to vary the Order it must file its own application setting out in full what it is asking the Tribunal to do and why. The letter that has been filed with the Tribunal is not sufficient for that purpose. If Trend-Line is asking for an extension of time for the filing of it response to the application the request is denied. The extension requested is for far too long a period of time.
[3]. Given that the Rules of Practice of the Pay Equity Hearings Tribunal require Trend-Line’s response to have been filed on December 9, 2010 and a response has not yet been filed, the Tribunal hereby extends the deadline by which Trend-Line must file its response to Monday, December 20, 2010.
