Decision of the Tribunal: November 15, 2010
1The Tribunal is in receipt of correspondence dated November 3, 2010 requesting that this matter be scheduled for two days of hearing for evidence and final argument on one outstanding issue concerning the gender of a job class.
2The applicant is hereby directed to deliver to the respondent and file with the Tribunal no later than fifteen (15) days from the date of this decision submissions containing the following:
- a statement of the issue that remains outstanding between the parties;
- the applicant’s position in respect of this issue;
- a statement of all facts that the applicant relies upon in support of its position;
- a list of all witnesses that the applicant intends to call at the hearing;
- a statement as to what each of the witnesses that the applicant intends to call will say at the hearing; and
- a copy of all documents that the applicant relies upon in support of its position.
3The respondent is hereby directed to deliver to the applicant and file with the Tribunal no later than ten (10) days from the date on which it receives the applicant's submissions as directed in the foregoing paragraph, the following:
- a statement of the issue that remains outstanding between the parties;
- the respondent's position in respect of this issue;
- a statement as to which of the facts asserted by the applicant the respondent agrees with and which of the facts it does not agree with;
- a statement of all facts that the respondent relies upon in support of its position;
- a list of all witnesses that the respondent intends to call at the hearing;
- a statement as to what each of the witnesses that the respondent intends to call will say at the hearing; and
- a copy of all documents that the respondent relies upon in support of its position.
4The applicant is hereby directed to deliver to the respondent and file with the Tribunal no later than five (5) days from the date on which it receives the respondent's submissions as directed in the foregoing paragraph its reply to the submissions of the respondent. Such reply must include a statement as to which of the facts asserted by the respondent the applicant agrees with and which of the facts it does not agree with.
5This matter is hereby referred to the Registrar to schedule two days of hearing to take place no earlier than 30 days from the date of this decision.
