Decision of the Tribunal

1By way of decision dated February 24, 2009, Haydon Youth Services was provided with a copy of an application that had been filed with the Pay Equity Hearings Tribunal (the “Tribunal”) by Brandi Antoniak. Haydon Youth Services was directed to post copies of a Notice of Application to Employees in the workplace as well as hand deliver or mail copies of the Notice of Application to Employees to existing and former employees listed in an Order issued by a Pay Equity Review Officer on March 4, 2005. In addition, the Pay Equity Office was directed to mail a copy of the same documents to each of the confidential employees. The Notice of Application to Employees advised employees that Ms. Antoniak had filed an application and invited them, if they wished to participate in any hearing that the Tribunal might hold, to file a response.

2On March 2, 2009, the Tribunal received correspondence from Brandi “Brooker” citing File No. 0803-07-PE stating “Please accept this letter as the withdraw [sic] of my application dated May 14, 2007.” As a result, of Brandi Brooker’s reference to the application as one having been filed by her, we assume that Brandi Brooker is one and the same as the applicant herein, Brandi Antoniak.

3Having regard to the request of the applicant, this application is hereby withdrawn.

4As a result of this withdrawal, we hereby direct Haydon Youth Services to post a copy of this decision in the workplace on top of any Notice of Application to Employees previously posted and to hand deliver or mail a copy of this decision to any existing or former employees to whom it has sent a copy of the Notice of Application to Employees. The Pay Equity Office is similarly directed to mail a copy of this decision to any confidential employees to whom it has provided a copy of the Notice of Application to Employees.

5By way of this decision, the Tribunal advises that the application filed by Ms. Antoniak (now Ms. Brooker) has been withdrawn by her and will not be processed any further by the Pay Equity Hearings Tribunal. The Tribunal will not be taking any action in connection with the application and the Tribunal’s file is now closed. Employees are advised not to send responses to the Tribunal.
