We are in receipt of correspondence from counsel for the applicant requesting that the hearing in this matter scheduled for October 16, 2008 be converted to a further Pre-Hearing Conference with Vice-Chair McKellar. An initial Pre-Hearing Conference was convened by Vice-Chair McKellar on August 23, 2007. The applicant contends that certain preliminary matters remain outstanding.
In our view, the preliminary issues may be dealt with by the hearing panel at the outset of the hearing on October 16, 2008. Accordingly, we decline to convert the hearing to a Pre-Hearing Conference.
