DECISION OF THE TRIBUNAL; January 2, 2007
1. The Belleville Police Services Board (“the Employer”) made an Application to the Tribunal on December 18, 2006 in respect of a Review Officer’s Order made November 7, 2006. The Order required the Employer to address a wage gap that was found to have arisen in respect of incumbents in one job class in a bargaining unit represented by the Belleville Seniors Officers’ Association.
2. With the Application, the Employer enclosed a Pay Equity Agreement, dated December 12, 2006. The Pay Equity Agreement is signed by the Employer, the Belleville Senior Officers’ Association and the incumbents in the job class who made the complaint to the Pay Equity Commission that resulted in the Order. By way of the Pay Equity Agreement, the parties have agreed to a different way to address the wage gap.
3. The Tribunal finds that the parties to this Application have made a settlement pursuant to section 25.1 of the Pay Equity Act, R.S.O. 1990, c. P.7 ,as amended ( “the Act”). Section 25.1 provides:
(1) The parties to a matter in respect of which the Hearings Tribunal is required to hold a hearing may settle the matter in writing.
(2) A settlement under subsection (1) binds the parties to it.
(3) If a bargaining agent is a party to a settlement under subsection (1), the settlement also binds the employees who are represented by the bargaining agent.
4. This Application requires no further intervention of the Tribunal.
