Pay Equity Office v. Jaba System Inc.
0398-06-PE Pay Equity Office, Applicant v. Jaba System Inc., Respondent.
BEFORE: Mary Anne McKellar, Vice-Chair, Margaret Kvetan and Pauline R. Seville Members.
APPEARANCES:
CITE AS: Jaba System Inc. (0398-06-PE) (25 August 2006) (P.E.H.T.)
DECISION OF THE TRIBUNAL; August 25, 2006
1By decision dated July 4, 2006, we directed the responding party (“the Employer”) to comply with a Review Officer’s order. We further stipulated that the time frames for compliance with the requirements of the Order would run from the date of our decision. Our decision was final, rather than interim, in that the only issue before us was whether the Review Officer’s order had been complied with.
2By correspondence dated August 11, 2006, the Employer seeks an extension of time in which to comply with the Review Officer’s order. The Employer’s request is opposed by the applicant, the Pay Equity Office in its correspondence of August 17, 2006, which notes that the documents in the file illustrate that the Employer’s constant refrain throughout the years of its involvement with the Office and now with the Tribunal is that it needs more time to educate itself about pay equity before implementing it in its workplace.
3In the circumstances, we decline to reconsider our final decision and extend the time for compliance with the Review Officer’s order. The Employer should be aware that if it fails to comply with that Order in a timely fashion (time commencing to run as of July 4, 2006), the Pay Equity Office will be able to take steps to file and enforce the Tribunal’s decision in court.
Dated at Toronto, Ontario this 25th day of August, 2006.
