Decision
1. The Tribunal issued two decisions in this matter, dated August 25, 2003 and October 14, 2003. Bucyrus Blades of Canada Limited (“the Employer”) brought an application for judicial review in respect of both decisions. In a decision dated January 24, 2005, the Divisional Court granted the judicial review application. Leave to appeal was denied by the Court of Appeal on July 18, 2005.
2. In accordance with the decision of the Divisional Court, we hereby revoke the Review Officer’s Order dated December 3, 2002, pursuant to sections 23(3) and 25(2)(d) of the Pay Equity Act, R.S.O. 1990, c. P.7, as amended (“the Act”).
