By letter dated December 18, 2003, the Tribunal advised the Applicant that it did not appear that the Tribunal has jurisdiction to deal with her Application as the matters raised in it were not the subject of a complaint or investigation dealt with by the Pay Equity Commission. The letter noted that the Application on its face did not refer to the matter having been dealt with by the Pay Equity Office, and the Pay Equity Office had further advised the Tribunal that no complaint or objection in respect of the matter had been brought. The Applicant was invited to provide the Tribunal with further information or submissions on this issue by January 5, 2004.
The Applicant has not filed any submissions with the Tribunal. Accordingly, based on the Tribunal’s review of the file, its correspondence with the Pay Equity Office, and in accordance with the decisions in Haldimand-Norfolk (No. 2) (1990), 1 P.E.R. 13; Scarborough (No. 1) (1994), 5 P.E.R. 45; York Region Board of Education (No. 2) (1994), 5 P.E.R. 83; Liquor Control Board of Ontario (1994), 5 P.E.R. 97; Villa Colombo (1997), 8 P.E.R. 133; Kensington Village (2000-01), 11 P.E.R. 1; and Ongwanada (2001-02), 12 P.E.R. 1, this Application is dismissed because the matters it raises have not previously been the subject of a complaint, objection, or investigation by the Pay Equity Office and the Tribunal is consequently without jurisdiction to entertain it.
