The Town of Newmarket ("Applicant") has brought an Application concerning a Review Officer's Order dated October 4, 2002. Succinctly, the Officer concluded that the Pool Deck Supervisor's duties and responsibilities did change. Accordingly, the Officer ordered the Applicant to maintain pay equity for the Pool Deck Supervisor's job class by placing it in Grade 6 of the salary administrative programme effective September 1, 1991. Also, all salary compensation changes should reflect the job rate for grade 6 from September 1, 1991 to December 31, 1995. Further, the Officer ordered that all adjustments to the incumbents should be based on paid hours. The Officer ordered the Applicant to implement the Order within thirty (30) days upon receiving it.
The hearing on the merits was scheduled to be heard on September 17 and 18, 2003. However, the parties unanimously requested a further Pre-Hearing conference.
By a joint agreement, signed by all the parties, dated September 17, 2003, the parties asked "...the Tribunal to adjourn this matter sine die in order to allow them to pursue a settlement pursuant to section 25.1 of the Pay Equity Act."
The Tribunal notes that Nick Warman, Christine Fairbarn and Debbie Bacon are identified as affected parties. However, the Tribunal has not received any communication from them in this matter.
Based on the above circumstances, the Tribunal is satisfied that it is appropriate to adjourn this matter sine die. If any party is dissatisfied with the progress or outcome of the settlement discussions, it may reschedule the matter for a hearing on the merits. If none of the parties brings the matter back for a hearing within one year from the date of this decision, the proceedings will be terminated without further notice.
