By handwritten letter dated September 15, 2003, an individual whose name appears to be Ansley Emmanuelpillai identifies himself as someone who was working for Circle of Life and indicates a desire to “get on board” the current proceedings before the Tribunal. This letter does not appear to have been copied to the parties to this proceeding.
By letter dated September 17, 2003, the responding party Collin Buchanan has advised the Tribunal that he is not acting as an agent for any other persons who performed services for Circle of Life, and appears to take the position that only the three individuals who initially responded to the notice of this application are entitled to participate. It is not clear that this letter has been copied to the other parties, or to Mr. Emmanuelpillai.
It appears to the Tribunal that there may be a dispute about whether Mr. Emmanuelpillai can participate in the proceeding, and to what extent. The Tribunal further anticipates that Circle of Life and the Hospital may wish to take a position with respect to this issue. Having regard to the fact that the outcome of the pending judicial review application commenced by Circle of Life may have an impact on how the hearing proceeds, and given that the next scheduled hearing days before the Tribunal are in late January 2004, it is the Tribunal’s view that it would be premature at this time to resolve the issue of Mr. Emmanuelpillai’s status to participate in that hearing.
The Registrar is directed to provide Mr. Emmanuelpillai with copies of the following: the application and responses filed; the Tribunal’s previous decisions in this file; this decision; and the most recent Notice of Hearing. In the event that the judicial review application has not been heard and decided by January 1, 2004, the Tribunal may issue further directions or seek submissions with respect to how to proceed.
The Registrar is further directed to provide copies of Mr. Emmanuelpillai’s and Mr. Buchanan’s letters to the Tribunal with all copies of this decision.
