DECISION OF THE TRIBUNAL, JANUARY 11, 2002
1The Tribunal is satisfied that Mr. Deluzio has complied with the directives set out in its October 2, 2001 decision and grants his request to withdraw the Response filed on behalf of the anonymous group of employees. The style of cause will be amended accordingly.
2Mr. Podhorsky is directed to do the following:
- advise whether he continues to adopt the positions taken in the Deluzio Response by January 21, 2002. He may do this by letter copied to counsel for the Applicant and filed with the Tribunal.
- If he now wishes to file an amended Response this must be served on counsel for the Applicant and filed with the Tribunal by January 30, 2002. In the Response he is directed to respond to the issues raised in the application, set out the facts and events upon which he intends to rely, identify any alleged violations of the Pay Equity Act and indicate the remedies he is requesting.
3The Applicant may file a Reply to the amended Response. Any Reply is to be served and filed by February 13, 2002.
4The Tribunal asks the Applicant to advise whether a Pre-hearing Conference is still requested and, if so, directs the Applicant to set out the issues it wishes to address at the Pre-hearing Conference.
5Applicant’s Counsel is directed to particularize any continuing disclosure issues indicating what documents are required and the reason they are necessary and arguably relevant. Further, Counsel is directed to identify the outstanding procedural matters alluded to in her letter of October 19, 2001 which remain in issue. This information is to be provided to the Tribunal and the Respondent in writing by January 30, 2002.
