DECISION OF THE TRIBUNAL
This decision is made necessary due to the expiry of the appointment of Member Bruce Budd to the Pay Equity Hearings Tribunal. Mr. Budd was the Member Representative of Employees assigned to the panel hearing the Application by Humber College CAAT (the “College”). That panel has already issued one interim decision, Humber/Confederation CAAT (1998-99, 9 PER 45), and held a further day of hearing during which counsel for the College and the Pay Equity Office ( the “PEO”) made legal argument concerning the PEO’s jurisdiction to investigate and make orders about a pay equity plan in the absence of a complaint to the Review Services branch of the PEO.
Counsel for the PEO and the College agreed that this matter could be determined by way of written submissions.
Having considered the submissions of the parties we direct that, pursuant to s. 29.1(2)(a), a new Employee Member be placed on the panel hearing the matter and that the hearing should continue before the newly constituted panel.
The hearing panel will determine the manner in which the hearing will continue including the issue of whether a rehearing of the submissions on the jurisdiction question is required.
