DECISION OF THE TRIBUNAL, FEBRUARY 13, 1996
[1]. At the hearing of this application on February 13, 1996, counsel for the respondents sought an order requiring the applicants to disclose certain minutes of the Territorial Finance Council of the Salvation Army Territorial Headquarters for Canada and Bermuda. The respondents sought disclosure of all minutes from January 1988 to December 1993 that dealt with pay equity or with the financial dealings of the Council with respect to Salvation Army Territorial Headquarters, Divisonal Headquarters or the community-based institutions or centres.
[2]. The applicants opposed the requested disclosure on several grounds. Among other things, the applicants argued that the disclosure sought was overly broad and that a sufficient evidentiary basis had not been established. Counsel took the position that the material sought was not arguably relevant, and that confidential material with respect to officers would be included if such broad disclosure was ordered..
[3]. The panel made an oral ruling at the hearing, which ruling is set out below:
The applicants shall provide the respondents with copies of any minutes of meetings of the Territorial Finance Council between January 1988 and December 1993 that deal with pay equity or with the yearly review of the internal audits of the institutions. Minutes which deal with management issues at the institutions should be included where such issues have been identified in the annual internal audit. The names of Salvation Army Officers may be deleted from the minutes, as well as any portion of the minutes which deal with the responsibilities of an officer in his/her religious role. The names of specific institutions may be deleted and replaced by a reference to the Salvation Army Department or Division to which the institution belongs, except if the institution is one of the following: Broadview Village, Sunset Lodge, Booth Centre, Agincourt Temple, Metro Toront Correctional and Justice Services.
