DECISION OF THE TRIBUNAL, JANUARY 29, 1996
The Applicant filed an application with the Tribunal seeking revocation of a Review Services Order on the basis that the order exceeded the jurisdiction of the Pay Equity Act, R.S.O. 1990, c.P.7.
The Respondent has filed a response to the application to which the Applicant has replied.
The Applicant subsequently requested that the Tribunal hold its proceedings in abeyance pending the decision of an interest Board of Arbitration which the applicant says will have a significant impact on its Pay Equity application. The interest Board of Arbitration was asked to resolve all outstanding issues with respect to a collective agreement when the parties had bargained to impasse. Pay equity negotiations had already been completed at that time and the amended pay equity plan was in place. The Respondent opposes the request for a deferral of the Tribunal’s process.
Having reviewed the pleadings, and the correspondence filed, we decline to defer our proceedings.
We are not persuaded that the decision of the interest Board of Arbitration addresses the same issues as are before us. In particular it does not address whether the parties are implementing their current amended pay equity plan in accordance with its terms.
We direct the parties to contact the Registrar of the Pay Equity Tribunal forthwith, to set hearing dates.
