DECISION OF THE TRIBUNAL, JUNE 30, 1995
Ms. Sylvia Mahabir has been employed by the Kitchener‑Waterloo Hospital as an operating‑scheduling clerk for approximately twenty two and a half years. Subsequent to the decision of the Review Officer dated May 26, 1993, Ms. Mahabir filed a complaint under section 22(1) and s. 14 (2) of the Pay Equity Act, R.S.O. 1990, c.P.7.
Subsequent to the filing of the application, the applicant sought an arbitration under the collective agreement, and, therefore, writes an application to this tribunal for an adjournment sine die.
The Tribunal has considered the written submissions by the parties and has concluded that the application for adjournment sine die should be dismissed. Written reasons will be provided at a later date.
The applicant must therefore contact the Registrar within 30 days of the date of this order to advise whether the applicant intends to withdraw the main application, or, whether the applicant wishes to continue with the hearing.
If the Registrar is not contacted by the applicant within the 30‑day period, the Tribunal will presume that the application is withdrawn.
