ENDORSEMENT

[1] At the oral hearing, the panel adjourned this matter with reasons to follow. These are those reasons.

[2] The applicant seeks judicial review of a decision of the Human Rights Tribunal of Ontario (HRTO) dated March 3, 2025. The HRTO dismissed the applicant’s claim of discrimination. The HRTO proceedings have concluded.

[3] Among other responses to the application, the issue of prematurity was raised because the applicant had decided not to seek a reconsideration at the HRTO. The issue of prematurity was scheduled to be heard in this separate hearing, bifurcating the application for judicial review.

[4] We heard the submissions on prematurity, including on issues such as adequate alternatives and exceptional circumstances. We conclude that it is not advisable to separate the prematurity issue from the rest of the application given the potential relevance of the other issues raised in the application to the issue of prematurity.

[5] We therefore adjourned the prematurity issue to be decided by the panel hearing the full application for judicial review. As agreed by all the parties, we made no order as to costs for this hearing.

[6] The parties shall email the Court office, within two weeks from today, with their request for a date for the hearing of the application and any other requests being made to prepare the application for the hearing.
