ADDENDUM TO REASONS FOR DECISION

[1] On January 13, 2023, this court released Reasons for Decision dismissing the Applicant’s application for judicial review: Del Grande v. Toronto Catholic District School Board, 2023 ONSC 349. No costs of the application were ordered because the panel had not received any cost outlines or agreement on costs within the prescribed time period.
[2] Subsequent to the release of the Reasons, counsel for the parties advised the court that after the application hearing, they reached an agreement that the successful party would be entitled to $140,000 in costs. Counsel apparently forwarded their agreement to the court by email, however, it was not received by the panel.
[3] The Reasons for Decision are hereby varied to reflect that based on the parties’ agreement, the Respondent is entitled to costs of the application of $140,000.
