[1] ABCO One Corporation appeals the order of Matheson J. dated November 29, 2021 (2021 ONSC 7127) that dismissed its motion opposing confirmation of a report made by Associate Judge Wiebe following a consolidated construction lien action.
[2] The construction lien trial took place over 24 days and detailed reasons were issued on August 16, 2019. The motion to oppose confirmation of the report took three days and resulted in careful and thorough reasons by the motions judge.
[3] In this appeal, the appellant essentially repeats the arguments made before the motions judge and repeats challenges to findings of fact made by the Associate Judge. We see no error of law in the motions judge’s decision nor any palpable and overriding error of fact. Indeed, we agree with her decision and her reasons.
[4] With respect to her costs order, we find no error in principle and would not interfere with her costs order.
[5] Accordingly, the appeal is dismissed.
[6] Costs to Canada-Wide are fixed at $5,000 on a partial indemnity basis. Costs to Pomerleau are fixed at $25,000 which is a fair and reasonable amount in the circumstances.
