[1] The applicant has abandoned this application for judicial review. The respondent is entitled to costs. Substantial indemnity costs are not appropriate in this case.
[2] The amount sought by the respondent of $35,000 on a substantial indemnity basis, and approximately $25,000 on a partial indemnity basis, is far in excess of what is normally awarded by this court in these kinds of cases.
[3] We award costs payable by the applicant to the respondent in the amount of $10,000 all inclusive
