The motion for leave to appeal from the decision of Ferguson J. (2021 ONSC 2119) is dismissed, with costs to the Respondent, fixed at $15,000, in accordance with the terms of the Occupancy Licence which indicates that the Defendants “shall reimburse the Vendor [the Respondent], for all costs it may incur”.
