DECISION ON MOTION FOR LEAVE TO APPEAL
[1] The motion for leave to appeal from the decision of Nishikawa J. (2021 ONSC 14) is granted in respect to the issues set out in paras. 1a, 1b, and 1c of the notice of motion, but not in respect to the issues set out at para. 1d of the notice of motion. Costs of the motion for leave to appeal in the agreed amount of $6,750 inclusive, are payable in the discretion of the appeal panel.
