However, the court granted the motion for security for costs, finding that the appeal appeared frivolous and vexatious, the respondent had insufficient assets in Ontario, and the respondent was continuing to breach an existing injunction against publishing defamatory statements.
The respondent was ordered to post $20,000 as security for costs.
