CASE MANAGEMENT ENDORSEMENT
[1] This endorsement reflects a case management teleconference held on October 26, 2020.
[2] This application for judicial review shall be heard by a panel of three judges of the Divisional Court by Zoom videoconference on December 3, 2020.
[3] The applicant has served its application record.
[4] The respondent shall serve its application record by October 30, 2020.
[5] The applicant shall serve its factum by November 9, 2020.
[6] The respondent shall serve its factum by November 23, 2020.
[7] All application materials (including costs materials) shall be provided to the court by uploading them to Caselines no later than November 23, 2020.
[8] This is an expedited schedule, warranted in view of the issues in this case. As counsel knows, this is much faster than the parties could expect for an application in the normal course. This has been done to minimize the prejudice to either side of a stay being granted – or refused – pending decision by the panel hearing the application.
[9] The court hopes that the parties can agree on interim terms between themselves on a without prejudice basis so that a stay motion is not necessary. If such an agreement cannot be reached, then the parties may arrange a teleconference with me next week to settle a schedule for a motion for a stay pending return of the application.
[10] The court has endorsed its fiat on this endorsement this day; the unsigned version distributed to the parties today has the authority and effect of the signed version, a copy of which will be provided to the parties in due course after the suspension of ordinary court operations is lifted.
