[1] The motion for leave to appeal the costs order of Seppi J. dated October 3, 2018 is allowed only on the following question: did the trial judge err in ordering costs payable by Manny Marcos, a non-party to the action?

[2] Costs of the motion for leave to appeal are fixed at $5,000.00 payable in the discretion of the panel hearing the appeal.
