CASE MANAGEMENT ENDORSEMENT
[1] This endorsement reflects a case management teleconference held on August 13, 2020.
[2] This appeal from Deputy Judge McLean of the Owen Sound Small Claims Court has not proceeded forward since it was launched in January 2020.
[3] The Appellant, Tobermory Marine, shall order the transcripts from the trial and provide a certificate from the court reporter that the transcripts have been ordered by August 20, 2020. This certificate shall be served on counsel for the respondent and a copy shall be sent by email to the Divisional Court no later than August 20, 2020.
[4] The transcripts are required by September 11, 2020, and this deadline should be provided to the court reporter at the time that the transcripts are ordered. The trial itself was less than one full day, and so there should be no difficulty in obtaining the transcript by September 11, 2020, as directed in this endorsement.
[5] The appellant shall perfect the appeal (by serving all appeal materials including the appellant’s factum) by October 11, 2020.
[6] If the appellant fails to meet any of the deadlines set out in paragraphs 3 and 4, the respondent may schedule a further teleconference with the court for directions or for an order dismissing the appeal.
[7] Once the appellant has perfected the appeal, the appellant may ask the court to schedule the date of this appeal. The respondent may also seek to schedule the appeal, but only after the respondent has served responding materials (including his factum).
[8] Counsel for the respondent will be expected to establish a file sharing platform through which all appeal materials will be made available to the court in advance of the appeal. Further directions in this regard will be provided when the appeal is scheduled.
[9] The court has endorsed its fiat on this endorsement this day; the unsigned version distributed to the parties today has the authority and effect of the signed version, a copy of which will be provided to the parties in due course after the suspension of ordinary court operations is lifted.
