WHEREAS Stephen and Kathy Holt applied to the Farm Practices Protection Board, pursuant to Section 5 of the Farm Practices Protection Act for the Board's consideration of Mr. Gabon and Mrs. Elizabeth Abonyis' practice of manure storage and removal in their agricultural operation:
AND WHEREAS a Hearing commenced on December 6, 1994 with all of the evidence of the aggrieved parties being submitted, as well as evidence at the request of the Board, the agricultural operators not presenting evidence.
AND WHEREAS the parties to the hearing indicated their willingness to enter into an order, upon consent.
THE BOARD THEREFORE ORDERS ON THE CONSENT OF THE PARTIES:
Gabor Abonyi and Elizabeth Abonyi will change their practice of manure removal to the dry technique, which involves no washing of the barns with manure located within them prior to removal and which requires the repair of all leaking bowls for the supply of water to the broilers located on the premises.
The agricultural operators, Gabon Abonyi and Elizabeth Abonyi, shall insure that there shall be removal of manure forthwith from the barn to a disposal site off of the farm.
The agricultural operators acknowledge that such removal may require the installation of cement pads and other aids which shall be at their sole expense.
The Board shall cause its staff to use their best efforts to provide consultation from a qualified expert to the applicants and other aggrieved parties who gave evidence at the Hearing in relation to fly control.
