KENKEL J.:
[1] Sun Media and CTV have applied for a copy of Exhibit #1, the Agreed Statement of Facts filed in support of the guilty pleas by this accused.
[2] I've ordered that the court provide a copy of the Agreed Statement of Facts to the media representatives present.
[3] I remind all parties that two co-accuseds remain in the ongoing preliminary hearing. The Superior Court of Justice has held that a s.539 publication ban applies to all of the common evidence heard at a preliminary hearing and continues until all parties have been discharged or have completed their trial. See: R. v. Parent [2003] OJ No.2038 (SCJ) and Toronto Star Newspapers Limited v. Canada [2006] OJ No.5781 (SCJ). Members of the media may wish to obtain legal advice on this point prior to deciding whether to publish information regarding the evidence admitted on plea that was heard at the preliminary hearing.
