Reasons for Sentence
KENKEL J. (Orally):
[1] Mr. Williams pleaded guilty to Human Trafficking s. 279.01 on the first day of a 10-day trial. The plea followed a preliminary hearing where the complainant testified.
[2] The circumstances of the offence are set out in Exhibit #1. The offence committed was a cowardly one – confinement and exploitation of a child for financial benefit. The accused preyed upon a 15-year-old girl who had been living in a foster home. He confined her and compelled her to work as a prostitute.
[3] The accused is 23 and has a criminal record including convictions for robbery.
[4] Both counsel jointly submit that a 5-year sentence would be appropriate. With the exception of 9 days, the accused has been in custody since November 21, 2012 – 538 days or 1 year, 5 months, 22 days.
[5] At 1.5 to 1 credit (R. v. Summers, 2014 SCC 26) that's 794 days. Five years is 1825 days. 1825 days less credit for time served leaves a remainder to be served of 1031 days (33.9 months).
[6] There will be a SOIRA order for 20 years, a s. 109 order for life, and a DNA order.
