[1] Given that the order for security for costs related to the costs of the appeal and that the appeal was allowed in part, the sum of $5,000 posted as security for costs by the appellant should be returned to the appellant. Accordingly, the order dated December 1, 2008 is amended to provide that the sum of $5,000 posted by Steven Tonner as security for costs shall be released to Steven Tonner.
