[1] The appellant’s appeal was dismissed for reasons released April 17, 2008. In the reasons, the respondent was awarded costs of the appeal, which would be decided after this court received submissions. Submissions have since been received and considered.
[2] Given the complexity of the matter and the significant amount at issue, the respondent is entitled to costs of the appeal fixed in the amount of $23,623.26. This amount is on a partial indemnity scale and is inclusive of disbursements and GST.
