CITATION: R. v. Vaughan, 2007 ONCA 269
DATE: 20070413
DOCKET: C46302
COURT OF APPEAL FOR ONTARIO
DOHERTY, BORINS and FELDMAN JJ.A.
BETWEEN:
HER MAJESTY THE QUEEN
Respondent
and
GERALD MICHAEL VAUGHAN
Appellant
Daniel Brodsky amicus curiae
Grace Choi for the respondent
Connie Vernon for the Penetanguishene Hospital
Heard: April 11, 2007
On appeal from the disposition of the Ontario Review Board dated March 23, 2006.
APPEAL BOOK ENDORSEMENT
[1] The appellant is not here. He seeks an adjournment. Given the history of the matter, including this appellant’s failed attempt to secure an adjournment last week, the respondents oppose the adjournment request. There is merit to this position, however, we do not have to decide whether the request for an adjournment is bona fide. The appeal (and the later appeal C44999) are clearly moot. The appellant is now subject to a further detention order issued by the Board on March 9, 2007. All counsel agree that the appeals are moot. The appeals are dismissed.
