[2] We make no order as to the costs of the motion before Brockenshire J. No submissions as to costs were made to Brockenshire J., nor was the issue of costs of the motion raised on appeal to the Divisional Court.
[3] The Divisional Court’s order as to the costs of the appeal before it stands.
[4] We fix the costs of the appeal to this court of the MFP respondents and of the respondents Bondy Riley at $10,000 each, inclusive of disbursements and GST.
