COURT OF APPEAL FOR ONTARIO
RE:
HER MAJESTY THE QUEEN (Respondent) v. JOSEPH WATSON (Appellant)
BEFORE:
O'CONNOR A.C.J.O., WEILER and ABELLA JJ.A.
COUNSEL:
Constance Baran-Gerez for the appellant
Joan Barrett for the respondent
HEARD & ENDORSED:
July 4, 2003
On appeal from the conviction entered and the sentence imposed by Justice M. Masse dated June 27, 2002.
APPEAL BOOK ENDORSEMENT
[1] We did not call upon the Crown on the conviction appeal as we are of the view that the appellant does not meet the requirements for setting aside a guilty plea set out in R. v. Adgey (1973), 13 C.C.C. (2d) 177 (S.C.C.).
[2] We are satisfied that the sentence of 11 months was fit.
[3] The appeals from conviction and sentence are, therefore, dismissed.
