RESTRICTION ON PUBLICATION
Pursuant to Rule 2.2.2 of the HPDT Rules of Procedure and ss. 45-47 of the Health Professions Procedural Code, no one shall publish or broadcast the names of patients or any information that could identify patients or disclose patients’ personal health information or health records referred to at a hearing or in any documents filed with the Tribunal. There may be significant fines for breaching this restriction.
The Ontario Massage Therapists Discipline Tribunal is the Discipline Committee established under the Health Professions Procedural Code.
Introduction
1The Inquiries, Complaints and Reports Committee (ICRC) of the College of Massage Therapists of Ontario (College) referred to this Tribunal allegations that the registrant sexually, verbally and/or physically abused a patient, failed to keep records as required, contravened standards of practice of the profession, and/or engaged in disgraceful, dishonourable or unprofessional conduct.
2The registrant has resigned from the College and agreed that he will never reapply to this College or any other massage therapy regulatory body in Canada. As part of the agreement, the College, with the agreement of the registrant, asked the Tribunal to adjourn the discipline proceeding indefinitely. I grant the request.
ANALYSIS
3The registrant has agreed never to practise massage therapy again in Canada. Both parties will save the time and costs of a hearing. Witnesses will be spared from the need to testify. There is a quicker and certain outcome. The outcome is transparent through this decision and the posting of the undertaking on the College’s public register, as required by the Health Professions Procedural Code, Schedule 2 to the Regulated Health Professions Act, 1991, S.O. 1991, c. 18.
4This matter remains formally before the Tribunal so that in the highly unlikely event the registrant were to reapply for registration with the College or apply for registration in another jurisdiction in Canada, the College could go forward with the discipline hearing in addition to the other legal remedies available.
ORDER
5This hearing is adjourned indefinitely. I am not seized, which means that if the hearing were to recommence, it need not come before me.
