MEMORANDUM OF ORAL DECISION DELIVERED BY D. ARNOLD ON February 3, 2026 AND ORDER OF THE TRIBUNAL
1This fifth Case Management Conference (“CMC”) was held with respect to an appeal pursuant to subsection 41(12) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, (“Planning Act”) by Worldwide Properties (Alliston) Inc. (“Appellant”) pertaining to the failure of the Town of New Tecumseth (“Town”) to approve the plans or drawings required by section 41 of the Planning Act in connection with the proposed additional commercial and retail development on the lands municipally known as 17-37 Young Street in the Town of New Tecumseth within 60 days after receipt by the Town of such plans or drawings (“Appeal”).
2The parties advised the Tribunal that the exchange of expert technical comments and questions with regard to the engineering, traffic and other studies pertaining to the Appeal has been ongoing between them. The parties are optimistic that a significant number of the issues on the proposed draft Issues List that was submitted for this CMC may be resolved or narrowed in the coming weeks as consultation continues between the experts of the respective parties.
3The parties requested that a further CMC be scheduled in early March 2026, at which time either a draft Procedural Order including Issues List will be considered or alternatively, subject to the approval of the Tribunal, such CMC may be converted to a settlement hearing.
4Further, the parties requested that hearing dates be scheduled for mid-May, 2026 so that a hearing on the merits of the Appeal may proceed expeditiously in the event that the parties are unable to resolve all of the outstanding issues pertaining to the Appeal. The parties estimated that 4-5 hearing days would be required in the event that all issues of the Appeal remain to be adjudicated. The parties advised that they are optimistic that at least some of the issues will be resolved or narrowed in the coming weeks prior to the next CMC.
5With the consensus of the parties, the Tribunal directed as follows:
(a) A sixth Case Management Conference is scheduled to take place on Friday March 6, 2026 at 10 a.m. by video. Details pertaining to this Case Management Conference are provided below.
(b) The Parties are directed to provide a further revised draft Issues List to the Tribunal through the case co-ordinator for this matter by no later than Tuesday March 3, 2026 for the purposes of the Tribunal’s consideration of issuance of a procedural order in respect of the hearing on the merits of the Appeal or alternatively to submit a request to the Tribunal through the case co-ordinator that the sixth Case Management Conference be converted to a settlement hearing, and submit a witness statement or affidavit in support of the proposed settlement, by no later than Tuesday March 3, 2026; and
(c) A four day hearing on the merits of the Appeal is scheduled to take place commencing Tuesday May 12, 2026 at 10 a.m. by video and continue to and including Friday May 15, 2026. Details pertaining to this hearing are provided below. Depending upon the status of the issues of the Appeal at the time of the sixth CMC, the Tribunal may consider whether the number of hearing days may be shortened. Details pertaining to this hearing are provided below.
