MEMORANDUM OF ORAL DECISION DELIVERED BY DAVID BROWN ON JANUARY 23, 2026 AND ORDER OF THE TRIBUNAL
1The Tribunal convened a Case Management Conference (“CMC”) concerning Appeals filed by Sorbara/Tribute Brubacher Holdings Inc. (“Appellant”), pursuant to s. 22(7), of the Planning Act, R.S.O. 1990, c. P.13, as amended (“Planning Act”) against the Township of Centre Wellington (“Township”) for its failure to make decisions within the timeframes prescribed by the Planning Act on the Appellant’s applications to amend the County of Wellington (“County”) and Township Official Plans.
2The Appellant owns approximately 42 hectares of land located at 6586 Beatty Line North (“Subject Lands”). The Subject Lands abut the northerly boundary of the Fergus Settlement Area. The applications propose to expand the Urban Boundary to include the Subject Lands and redesignate those lands for future residential development.
3The Tribunal received an Affidavit of Service sworn on January 5, 2026, confirming that the Notice for the Appeals was served in accordance with the directions provided by the Tribunal.
4Four landowners are currently seeking approval of applications proposing to amend the County and the Township Official Plans proposing to expand the Fergus Settlement Area. The landowners have each appealed their respective applications to the Tribunal and the Appellant is one of the four landowners.
5Elora Sands Development Inc. (“Elora Sands”) is one of the four landowners and their second CMC is scheduled for March 16, 2026. Elora Sands, together with the remaining two landowners, Tribute (Fergus Oaks) Ltd. (“Fergus Oaks”) and Polocorp Inc. (“Polocorp”) are seeking Party status in these proceedings. The four landowners contend that the most efficient manner to deal with their respective appeals is to have all four appeals considered at the March 16, 2026 CMC. This will enable the coordination of the hearing process and the issues to be decided at a merit hearing.
6Counsel for Polocorp and Fergus Oaks advised they have requested the Tribunal schedule their first CMC on March 16, 2026 and are still awaiting confirmation of the scheduling.
7The Tribunal received a further Party Status Request from Suraj Saini. The request was similarly deferred to the next CMC with the other requests. The Tribunal encouraged Mr. Saini to review the requirements and expectations of an individual granted Party status in contrast to that of Participant status prior to the next CMC.
8A Participant Status Request was received from the Wellington Catholic District School Board (“School Board”). The Tribunal considered the request and found the School Board has an interest in the proceedings, and with the consent of the Appellant, granted Participant status to the School Board.
9The Tribunal, having considered the submissions of the Counsel, finds the appeals have a common issue before the Tribunal, it being the proposed expansion of the settlement boundary, and conducting a CMC of the matters together is a fair, expeditious, and cost-effective approach to establish appropriate procedural orders for consideration of the appeals.
10The Tribunal defers the consideration of the Party Status Requests to the next CMC, to be considered with the requests filed with respect to the other appeals.
11The Tribunal schedules a second CMC for this matter to proceed on Monday, March 16, 2026 at 10 a.m. by video conference.
