MEMORANDUM OF ORAL DECISION DELIVERED BY T.F. NG ON JANUARY 27, 2026 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the first Case Management Conference (“CMC”) for the above-noted matter. Stylux Bowmanville Inc. (“Appellant”) has filed appeals against the Municipality of Clarington’s (“Municipality”) failure to make a decision within the statutory time frames for the Appellant’s application to permit the development of 97 three-storey townhouse units in respect of the property municipally known as 500 Mearns Avenue. The appeals were pursuant to s. 22(7), s. 34(11) and s. 51(34) of the Planning Act (“Act”).
2The Affidavit of Service on file was marked as Exhibit A.
PARTY / PARTICIPANT REQUESTS
3The Party Status request of Central Lake Ontario Conservation Authority (“CLOCA”) was, by consent, granted by the Tribunal.
4The Participant Status request of Nadine Taylor was, without objections, granted to her.
DRAFT PROCEDURAL ORDER
5The Tribunal received a draft Procedural Order (“PO”) with the Municipality’s and CLOCA’s issues lists. Counsels requested a three-week hearing to be scheduled, as the total expert witnesses to be called will be in the range of 10 – 15 witnesses.
MEDIATION
6The Municipality and the Appellant were in amicable discussions, and after CLOCA’s addition, will further review and scope the issues. Parties will be open to mediation, if the need arises.
DISPOSITION
7The Tribunal will schedule a 15-day Hearing. There is no further notice, and the member is not seized.
8The Tribunal directs that the PO with the deadlines filled in, together with the Issues list, be forwarded to the Case Coordinator by February 17, 2026.
HEARING
9The Hearing is scheduled to proceed by video at 10 a.m. from Monday, November 30, 2026 to Friday, December 11, 2026 (10 days) and continued from Monday, January 11 to Friday, January 15, 2027 (5 days).

ORDER
14THE TRIBUNAL ORDERS that:
Party Status is granted to the Central Lake Ontario Conservation Authority.
Participant Status is granted to Nadine Taylor.
The Procedural Order and Issues List be filed by February 17, 2026.
The 15-day Hearing is as scheduled.
