THIS MATTER, in respect of an appeal relating to the expropriation by Metrolinx of a subsurface portion of the property located at 40 Eaton Avenue in the City of Toronto (“Subject Property”), came before the Ontario Land Tribunal (“Tribunal”) on January 23, 2026, for its first Case Management Conference (“CMC”). The Parties were not prepared for the CMC.

THE TRIBUNAL Member was informed that the Parties are engaged in productive discussion concerning mediation. In addition, there has been communication with counsel for other property owners in the vicinity of the Subject Property with respect to mediation or possibly hearing of the appeals at the same time, in accordance with Rule 16.3. As such, it was considered premature to schedule a second CMC at this time. The Parties were informed that Tribunal-led mediation can be arranged through the Case Coordinator.

The Member is not seized.
