THIS MATTER having come before the Tribunal for a public hearing on May 2, 2025 and the Tribunal, in its Decision and Interim Order issued on August 12, 2025, having ordered that the appeals by DRC (Markham) Inc. against the City of Markham’s failure to make a decision on official plan amendment and zoning by-law amendment applications (together, “Instruments”) are allowed, in part;
AND THE TRIBUNAL having withheld its final approval of the Instruments contingent upon written confirmation by counsel to all Parties that the Tribunal has been provided with the final form of the proposed Instruments satisfactory to the Parties in form and content (“Final Instruments”);
AND THE TRIBUNAL having received the Final Instruments on January 23, 2026;
AND THE TRIBUNAL now being satisfied that the conditions for the release of the Tribunal’s Final Order with respect to the Final Instruments have been satisfied;
THE TRIBUNAL ORDERS that:
- The official plan amendment attached to this Order as Attachment “1” is approved; and
- The zoning by-law amendment attached to this Order as Attachment “2” is approved.
